This practice advisory will review the general requirements for DACA, as well as issues advocates should look out for when determining eligibility. There has been a lot of interest from community members and advocates about the DACA program since a federal court reinstated initial DACA applications in November of 2020. It is important to note that although DACA has been restored, there are still threats from pending litigation1 that could end the program entirely.
